LYNX Services, L.L.C. Web site Terms and Conditions of Use.

LYNX Services, L.L.C. ("LYNX Services"), provides the information and services on its World Wide Web site(s) ("Site") under the following terms and conditions. By accessing and/or using the Site, you indicate your acceptance of these terms and conditions. The METRYX Registry and ClaimPoint are governed by the Terms and Conditions of Use set forth in that portion of the Site.

LAWS AND REGULATIONS. Access to and use of this Site are subject to all applicable international, federal, state and local laws and regulations. User agrees not to use the Site in any way that violates such laws or regulations.

COPYRIGHT AND TRADEMARKS. The information available on or through this Site is the property of LYNX Services or its licensors, and is protected by copyright, trademark, and other intellectual property laws. Users may not modify, copy, distribute, transmit, display, publish, sell, license, create derivative works or otherwise use any information available on or through this Site for commercial or public purposes. Users may not use the trademarks, logos and service marks ("Marks") for any purpose including, but not limited to use as "hot links" or Meta tags in other pages or sites on the World Wide Web without the written permission of LYNX Services or such third party that may own the Mark.

LYNX Services respects the intellectual property of others. If you believe in good faith that any materials on the Sites infringe upon your copyrights please send the following information to LYNX Services' Copyright Agent at copyright@prangerlaw.com:

1. identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
2. identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
3. your address, telephone number, and email address;
4. a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
5. a statement by you, made under penalty of perjury, that the information in your notification is accurate, and that you are the copyright owner or are authorized to act on the copyright owners behalf;
6. a physical or electronic signature of the copyright owner or the person authorized to act on behalf of the owner of the copyright interest.

NO LICENSE. Except as expressly provided above, nothing on this website shall be construed to confer by implication, estoppel or otherwise, any license or right under any patent, trademark, or copyright.

TAMPERING. User agrees not to modify, move, add to, delete or otherwise tamper with the information contained in LYNX Services Web site. User also agrees not to decompile, reverse engineer, disassemble or unlawfully use or reproduce any of the software, copyrighted or trademarked material, trade secrets, or other proprietary information contained in the Site.

LINKS TO THIRD PARTY SITES. This Site may contain links that will let you access other Web sites that are not under the control of LYNX Services. The links are only provided as a convenience and LYNX Services does not endorse any of these sites. LYNX Services assumes no responsibility or liability for any material that may be accessed on other Web sites reached through this Site, nor does LYNX Services make any representation regarding the quality of any product or service contained at any such site.

LINKS FROM THIRD PARTY SITES. LINKING RIGHTS POLICY: Use of Hyperlinks. You may display on your website the Hyperlink to LYNX Services Site for purposes of enabling users of your site to link to LYNX Services Site. The Hyperlink shall at all times be displayed in its entirety and not in association with any text, graphics, logos, trademarks, or trade names (whether of LYNX Services or another party) or any information which is misleading or otherwise misrepresents the nature of the Site with which the Hyperlink will connect or which is in any way derogatory, of negative connotation, or otherwise negatively impacts on the good will of LYNX Services in the Hyperlink or your website. LYNX Services uses reasonable efforts to include accurate and up-to-date information on this Site; it does not, however, make any warranties or representations as to its accuracy or completeness. LYNX Services periodically adds, changes, improves, or updates the information and documents on this Site without notice. LYNX Services assumes no liability or responsibility for any errors or omissions in the content of this Site. Your use of the Site is at your own risk.

LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES SHALL LYNX SERVICES BE LIABLE FOR ANY DAMAGES SUFFERED BY YOU, INCLUDING ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS OR DAMAGES FOR BUSINESS INTERRUPTION, LOSS OF INFORMATION, PROGRAMS OR OTHER DATA) THAT RESULT FROM ACCESS TO, USE OF, OR INABILITY TO USE THIS SITE OR DUE TO ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF INFORMATION THROUGH THE INTERNET, EVEN IF LYNX SERVICES WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

PRIVACY. Protecting the privacy of our clients and users of our Sites is important to LYNX Services. The LYNX Services Site Privacy Statement below describes how we use and protect information you provide to us. (See Privacy Statement below).

SECURITY. Data transmitted to and from LYNX Services client and users Sites are encrypted for the user's protection. However, the security of information transmitted through the Internet can never be guaranteed. LYNX Services is not responsible for any interception or interruption of any communications through the Internet or for changes to or losses of data. User is responsible for maintaining the security of any password, user ID, or other form of authentication involved in obtaining access to password protected or secure areas of LYNX Services sites. In order to protect you and your data, LYNX Services may suspend your use of a client or user site, without notice, pending an investigation, if any breach of security is suspected.

ACCESS TO PASSWORD PROTECTED/SECURE AREAS. Access to and use of password protected and/or secure area of the Site is restricted to authorized users only. Unauthorized access to such areas is prohibited and may lead to criminal prosecution.

DOMESTIC USE/EXPORT RESTRICTION. This Site is operated in the United States and presented for the purpose of promoting LYNX Services and its affiliated companies therein. Use of this Site from other locations may not be appropriate, and LYNX Services makes no representations about such usage. Without limiting the generality of the foregoing, this Site may not be used by users subject to the privacy laws and regulations of the European Union. Viewers who access this site from locations outside the United States do so on their own initiative and must bear all responsibility for compliance with local laws, if applicable. Further, the United States Export Control Laws prohibit the export of certain technical data and software to certain territories and countries. No content from this Site may be downloaded in violation of United States law.

JURISDICTION AND CHOICE OF LAW. These terms and all claims related to this Site shall be interpreted and reviewed under the laws of the United States and the State of Delaware (without regard to the conflicts of laws rules of that or any other jurisdiction). Any claim arising in connection with these terms or this Site must be commenced within one (1) year after such claim arises.

NO WAIVER. LYNX Services failure to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

SEVERABILITY AND INTEGRATION. If any provision of these terms is found by a court of competent jurisdiction to be invalid or unenforceable, you and LYNX Services shall nevertheless agree that the court should give effect to LYNX Services intentions as reflected in such provision, and the other provisions of these terms shall remain in full force and effect.

CHANGES. LYNX Services reserves the right to modify these terms at any time, without prior notice. Your continued access to or use of this website shall be deemed to be your acceptance of these terms, as changed. For this reason, we encourage you to review these terms whenever you visit this website.
